Abstract: Under the “separation of three rights”, the land management right is separated from the land contract management right. In order to clarify the nature of the rural land management right, facilitate the transfer and claim of legal rights to a third party, and facilitate the protection of the legitimate rights and interests of the parties. By considering the current situation of land management right transfer, it is found that there are some problems in land management right transfer, such as imperfect registration system, imperfect dispute resolution mechanism, lagging management service and so on. It is suggested to improve relevant supporting laws and regulations, standardize the transfer mode of land management right, strengthen the supervision of land management right transfer, and improve the dispute resolution mechanism, market management service level and social security system, so as to better promote the transfer of land management right and revitalize rural land.
