Abstract: Comprehensively administering the country according to law is the essential requirement and important guarantee of socialism with Chinese characteristics. Due to the lack of development of the modernity of the villagers and the rural clan culture, the negative part of the clan group is often based on the narrow interests of the family. The clan fighting consciousness becomes a tool to interfere and resist administrative power. It was discussed the main political issues of the clan in the context of the rule of law in the new era and the influence of clan on the construction of the legal system. The countermeasures for the stable development of clan governance were put forward to provides reference for the standardized and orderly rural governance.
